PAYMENT TO GENERAL REASONS AND REAL ESTATE

 


I-REASON


The payment on account of the price, obeys a double reason :

-a-Strengthen the business relationship established between the parties.

-b-Minimize the risk related to the decay of the operation ; both for the manufacturer, promoter or service provider; as well as for the purchaser or recipient of said service.

-w- Reason why the parties usually agree to the delivery of part of the price, prior to the termination of the legal relationship.


II-TIME OF DELIVERY


Regarding the time of delivery of this part of the amount of the price and amount :

-u-This commonly takes place at the signing of the contract, order or work order.


III-AMOUNT


The amount will depend on the purpose of the contract and its value, and may range between :

-a-20% to 30%, in case of provision for services provided.

-b- 8% to 20%, in case of real estate transfers of property.


IV-DELIVERY OF SUCCESSIVE AMOUNTS


Sometimes the parties agree
to the delivery of successive amounts of money, as the manufacturer or service provider develops its activity.

Unless otherwise agreed, nothing would prevent the buyer or recipient of the service from voluntarily advancing amounts on account of the price.


V-PAYMENT ON ACCOUNT REINFORCED BY ARRAS CLAUSES


In the real estate field, the payment on account of the price ; often is reinforced by Arras Clauses.
