WARRANT
I-CASES WHEN HAPPENS.
A warrant, is enforced by a Judge usually for three reasons :
-a-The case in which the Court must notify a resolution-In this is the case the person cannot be found.
-b-The case of accomplishing a court resolution-For instance a statement, or attendance to a trial, or entry in prison.
-c-Case of an evasion from a prison-When the person has evaded from custody.
II-REASON.
The State has an administration of justice, and therefore he resolutions issued by this administration must be accomplished in the benefit of the citizens.
In the three cases, the person will be detained by the police, to accomplish whats the court requires.
When is somebody evaded from prison, or an individual who did not came back from permission, the authorities will previously verify he is not in another prison for any other reason.
Once the search has been started, the Public Prosecutor, will be able to declare the individual in contempt to justice.
Referring how quick administration will react, it depends on the importance of the offence, how urgent it is, the kind of offence, and how dangerous the individual is.
III-OUTCOME :
Once the person is found and arrested ; the process will vary depending if it is only to notify something, or there is an enforceable sentence, or if he is evaded.
When arrested the person, the police will communicate with the court, and then :
-a-Notification will be made.
-b-Will eventually determine his immediate entrance in prison.
-c-The court will possuibly issue a writing of preventive prison.
-w-The warrant, will lose its effect, from the moment the court decides, because the task that had to be done has been accomplished, or liability is extinguished, or because of death of the person, or offence is prescribed, or commuted penalty, or other.
